Sure! If you want him captured in one of the makeshift, easily broken jails, make sure he's caught while in the Neutral Zone.

If you have him caught in Minaras, he'd be put in higher-security confinement, and that'd be harder to break him out of. (Still workable, but we'd need to plot, and it sounds as if you're keen to have him in the tower too — Neutral Zone is an easier bet!)
